GSB Healthcare Team Published in Legal Magazine

An article by two members of the GSB Healthcare Team was recently selected for publication in Common Defense, a magazine by the Kentucky Defense Counsel, Inc.  Sarah E. Tilley and David L. Haney authored “Kentucky’s Convoluted Path to Fundamental Fairness for Tort Defendants.” The article explored Kentucky’s tangled procedural mechanism that defendants must use when seeking an apportionment instruction to include a non-party joint tortfeasor who is responsible for all or a part of a plaintiff’s injuries.

The article analyzed a 2013 opinion from the U.S. District Court for the Eastern District of Kentucky, Compton v. City of Harrodsburg, which explains Kentucky’s current practice for seeking apportionment as to a non-party joint tortfeasor, as well as the procedure in other jurisdictions.
