On September 6, 2013, GSB attorneys Robert Gwin and Rebecca Wood received a favorable decision from the Kentucky Court of Appeals on behalf of an institutional trustee client. GSB’s client was trustee of two split interest trusts which had a common income beneficiary but different remainder beneficiaries. Following termination of the trusts, the remainder beneficiaries of one of the trusts filed suit claiming that the trustee had violated its duties of prudence, impartiality and loyalty in its administration of the trust. GSB attorneys moved for and the trial court granted summary judgment to the trustee on all significant issues. The plaintiff appealed to the Kentucky Court of Appeals who upheld the trial court’s ruling.
