Ms. Pearson is a member of the firm’s Nursing Home Defense Team. In this capacity, Ms. Pearson handles cases on behalf of owners and operators of hospitals, nursing homes and acute care facilities in multiple jurisdictions, including Kentucky and West Virginia. She defends against medical negligence claims, along with claims of inadequate staffing and statutory violations of long-term care residents’ rights.
Ms. Pearson also provides advice for employers regarding issues of hiring, firing, accommodations, FMLA leave, wage and hour issues, diversity training, employment policies and employee handbooks. Additionally, Ms. Pearson has assisted employers in defending against charges of various types of discrimination, including race, sex, religious, national origin, disability, and sexual orientation. Ms. Pearson has handled cases involving retaliation, wrongful discharge, defamation, sexual harassment, and collective actions under the FLSA. Ms. Pearson also speaks on various employment laws at seminars and conferences around the state, including the topics of the FMLA, the ADA, the FLSA and sexual harassment training.
Ms. Pearson’s two areas of practice make her uniquely situated to provide advice regarding labor and employment issues to healthcare providers.
Ms. Pearson graduated summa cum laude from Franklin College of Indiana in 1999. She then attended the University of North Carolina School of Law, where she earned her J.D. cum laude. In law school, Ms. Pearson was a member of the University of North Carolina’s Kenneth Broun National Trial Team. In her third year of law school, Ms. Pearson competed on the National Level at the American Trial Lawyer’s Association annual mock trial competition. She was also the recipient of the Eugene Gressman and Daniel Pollitt Award for exemplary skill in appellate advocacy. Ms. Pearson served as a member of the North Carolina Journal of International Law and Commercial Regulation. The Journal published Ms. Pearson’s comment which centered on human rights issues facing women in Turkey.
